Terms & Conditions

You agree to be bound by the following terms and conditions by using the Projecturf website(s) and / or products & services ("Terms of Service").

Projecturf reserves the right to update and make any necessary changes to the Terms of Service at any time without notice. Additionally, Projecturf will be adding new features and updates over time, which shall be subject to the Terms of Service. Using the service after any such changes shall constitute your consent to such changes. You can always review the latest version of the Terms of Service here.

Your account will be terminated if you violate any of the terms below. Projecturf prohibits such conduct and content while using the Service, and you agree that Projecturf cannot and will not be held responsible for any content posted on the Service. You may be exposed to such content and materials and therefore agree to use the Service at your own risk.

Setup and Account Terms

1. Accounts registered by "bots" or any other automatic means are not allowable.
2. You must enter a full legal name, a legitimate email address, and all other information asked for in order to complete the signup process.
3. The login you create may only be used by you. You may create separate logins for as many people as you'd like as project managers, and users.
4. You maintain full responsibility for the security and password of your account. Projecturf cannot and will not be liable for any loss or damage from your failure to comply with this security obligation.
5. You are liable for all content posted to your account (this includes all content posted by others who have accounts under / within your account).
6. Each person or entity may only maintain one free account (green plan).
7. This Service may only be used for lawful purposes. You must follow the laws outlined by your jurisdiction (including but not limited to copyright and security laws).

Payment and Account Change Terms

1. We require a credit card for all accounts excluding the free account. We do not require credit card information for free accounts.
2. If you choose not to continue with the service, you must cancel your account within 30 days of registering. When you cancel prior to the 30th day, you will not be charged.
3. By upgrading from the free Green plan to any paying plan will immediately end your free trial. Your credit card must be entered upon upgrading and you will be billed for your first month on that day.
4. Projecturf bills on a monthly basis only. We will not issue refunds for any reasons. There will be no exceptions to this rule.
5. All prices are free of any taxes or levies and you must follow your local government regulations (please contact your tax authorities for further questions).
6. If you upgrade your plan, your credit card that you have under "My Account" will automatically be charged the difference between your current plan and your new plan for the remaining days of the billing period. You will be billed at the new plan rate on your upcoming invoice date. We do not offer refunds for downgrades. Downgrading your Service may cause the loss or partial loss of your account data and features. Projecturf assumes no liability associated with your loss.

Ending your account with Projecturf

1. You are responsible for cancelling your own account as the account holder / administrator. You can cancel your account at any time by clicking on the "My Account" link in the top navigation bar and clicking on "Cancel Account" under Billing information. The Cancel Account screen provides a simple cancellation confirmation.
2. Everything under your account will be deleted upon cancellation (this includes all content, files, contacts, data, etc.). This information is permanently deleted and cannot be restored.
3. When you cancel the Service before your next billing period, you will not be charged again.
4. Projecturf, in its sole discretion, has the right to suspend or terminate your account and refuse any and all current or future use of the Service, or any other Projecturf service, for any reason at any time. Such termination of the Service will result in the deactivation or deletion of your Account or your access to your Account, and the forfeiture and relinquishment of all Content in your Account. Projecturf reserves the right to refuse service to anyone for any reason at any time.

Changes to the Service and Prices

1. Projecturf reserves the right at any time to modify the service in any form or fashion without prior notice, and this includes your account service and terms with Projecturf.
2. Changes in any Projecturf Services, including any charges or fees incurred by you, are subject to change at any time without notice. Projecturf will post any price changes on the Projecturf.com website in the pricing and sign-up page or the forum (http://forum.projecturf.com) or the Service itself.
3. Projecturf is not to be held liable to you or to any third party for any modification, price change, suspension or discontinuance of the Service.

Content and Data Terms

1. Projecturf has no intellectual property rights over your content and data within the Projecturf Service. Any content or files uploaded on the site remain yours. Once you make this content available to others on the Service, you allow them to view and share your content others.
2. Projecturf will not screen content posted to the Service, but Projecturf retains the right to remove any content from the Service.
3. The layout, design, and functionality of the Service is copyrighted to Projecturf, LLP. All rights reserved. You may not duplicate, copy, or reuse any portion of the HTML/CSS or visual design elements without express writtenpermission from Projecturf.

General Terms of Service

1. You agree to use Projecturf and all related Services at your own risk. You may receive technical support by email or our support forum. Support will be provided in order of the highest paying plans to the lowest paying plans.
2. Projecturf uses outside "third party" vendors and hosting partners to provide the necessary hardware, software, networking, backup, storage, and related technology required to run the Service.
3. You must not modify, adapt or hack the Service or modify another website so as to falsely imply that it is associated with the Service, Projecturf, or any other Projecturf service.
4. You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service without the express written permission by Projecturf.
5. We may, but have no obligation to, remove Content and Accounts containing Content that we determine in our sole discretion are unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene or otherwise objectionable or violates any party's intellectual property or these Terms of Service.
6. Verbal, physical, written or other abuse (including threats of abuse or retribution) of any Projecturf customer, employee, member, or officer will result in immediate account termination. You understand that the technical processing and transmission of the Service, including your Content, may be transfered unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices.
7. You must not upload, post, host, or transmit unsolicited email, SMSs, or "spam" messages.
8. You must not transmit any worms or viruses or any code of a destructive nature.
9. If your bandwidth usage exceeds 300 MB/month, or significantly exceeds the average bandwidth usage (as determined solely by Projecturf) of other Projecturf customers, we reserve the right to immediately disable your account or throttle your file hosting until you can reduce your bandwidth consumption.
10. Projecturf does not warrant that (i) the service will meet your specific requirements, (ii) the service will be uninterrupted, timely, secure, or error-free, (iii) the results that may be obtained from the use of the service will be accurate or reliable, (iv) the quality of any products, services, information, or other material purchased or obtained by you through the service will meet your expectations, and (v) any errors in the Service will be corrected.
11. You expressly understand and agree that Projecturf shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if Projecturf has been advised of the possibility of such damages), resulting from: (i) the use or the inability to use the service; (ii) the cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered into through or from the service; (iii) unauthorized access to or alteration of your transmissions or data; (iv) statements or conduct of any third party on the service; (v) or any other matter relating to the service.
12. The failure of Projecturf to exercise or enforce any right or provision of the Terms of Service shall not constitute a waiver of such right or provision. The Terms of Service constitutes the entire agreement between you and Projecturf and govern your use of the Service, super ceding any prior agreements between you and Projecturf (including, but not limited to, any prior versions of the Terms of Service).
